THE UNIVERSITY OF LIVERPOOL

REPORT OF THE BOARD OF APPEAL

1. The Board of Appeal which is established under Ordinance 16 (Discipline) met on 1, 8, 11 and 12 May 1970, to hear the appeals of nine students from the respective findings and penalties imposed by the Board of Discipline, following charges preferred by the Registrar arising out of the occupation of the Senate House.

2. With the exceptions indicated below, membership of the Board of Appeal was as follows:

Mr. EAG Caroe (President of the Council) (Chairman), Professor CEH Bawn (deputising for the Vice-Chancellor), Dr AW Beeston (Council), Mr BL Rathbone (Council), Professor LL Green (Senate), Professor H Myles Wright (Senate, deputising for Professor Myers) and Mr JG Gow (Convocation). Mr Gow was absent for the hearing of the appeals of four students and did not join in discussion of the Board’s decision on their appeals; Professor JM Meek deputised for Professor Bawn in one case on 8 May; Professor Bawn did not join in discussion of the Board’s decision on the appeal of one student.

3. The cases before the Board of Appeal fell into two separate classes:

A.  Appeals against penalty.

Three students, represented by a solicitor, appealed on these grounds.

The decisions of the Board were as follows:

(i) In two cases the penalty imposed by the Board of Discipline was confirmed;

(ii) In the other case the penalty was reduced to suspension from the University with effect from noon on Saturday, 11 April 1970 until the beginning of the Summer term 1971.

B. Requests for re-hearing of the charge de novo.

Six students each requested re-hearing of the charge or charges; these requests were granted by the Board. Five students were represented by a Professor of Law from another University whilst the sixth chose to conduct his own case. In all six cases, the Board found the charge or charges proved.

The penalties imposed by the Board of Appeal were as follows:

(i) One student was expelled from the University;

(ii) Four students were suspended from the University with effect from noon on Saturday, 11 April 1970 until the beginning of the Summer term 1972.

(iii) One student was suspended from the University with effect from noon on Saturday, 11 April 1970 until the beginning of the Summer term 1971.
